Dear Mr. Mathias:
I apologize for the long delay in writing to you about the work entitled QUARTET (1972). The nature of the work required an unusually detailed examination, which took some time.
...In indeterminate music, where the various parameters of the sounds and the order of their appearance are only imprecisely indicated and latitude is given the performer in interpreting and realizing the score, we must be certain that the composer has retained enough control so that at least a minimal amount of the final sounds are reduced to a tangible form of expression. Works that carry the principles of indeterminancy to their extreme (i.e., works that consist solely or predominately of textual matter explaining in very general terms only the method of performance, describing only the concept of a work, outlining only the general idea or plan for a musical production or providing only the rule matrix or basic performance materials) and that fix few or none of the actual or approximate sound pregressions, are not copyrightable in Class E.
The copy deposited of this work consists of four pages of text and a diagram or chart. The text includes a key identifying the various symbols,." such as a triangle for "type of attack" and a square for "amount of activity.' However, there is no indication of exactly what kinds of attack and activity take place. Neither the text nor the symbols on the chart fix a progression of specific or even approximate musical sounds. What we apparently have here is a plan or rule matrix for a composition...
